EzProofMe is a technical verification receipt service operated by Zwurkz Technologies, Inc. (“Zwurkz,” “we,” “us,” or “our”). This Privacy Policy explains how information is collected, processed, retained, disclosed, and protected when you use the Service.

1) Nature & Intended Use of the Service

EzProofMe generates digital receipts reflecting technical verification signals (timestamp, geolocation, device authentication confirmation, and selfie capture). The Service is not a surveillance system, forensic system, background check provider, identity guarantee, truth-certification mechanism, or law enforcement substitute.

Receipts reflect technical signals as processed. They do not constitute certified evidence or conclusive proof of identity or presence.

3) Biometric & Device Authentication Clarification

Biometric authentication (fingerprint, facial recognition, passkeys) is performed locally by your device. Zwurkz Technologies, Inc. does not receive, collect, store, or process raw biometric identifiers or biometric templates.

We receive only a success/failure confirmation from the operating system.

Terms such as “Biometric Identifier” and “Biometric Information” are interpreted consistent with applicable biometric privacy laws (including Illinois’ BIPA where applicable). Explicit written consent is governed by the Terms of Service.

4) Purpose of Processing

Zwurkz Technologies, Inc. does not sell biometric or personal data.

4A) Third-Party Disclosure and Reliance Risk

When you share, publish, transmit, or otherwise disclose a receipt or any verification data to another person or entity, you do so at your own discretion and risk.

Zwurkz does not control how third parties store, interpret, use, redistribute, or rely on such data once it has been disclosed.

Any third party who receives or views receipt data does so at their own risk and is solely responsible for their interpretation and use of such information.

Zwurkz shall not be responsible for any consequences arising from third-party access to or use of disclosed data, including misinterpretation, misuse, or unauthorized redistribution.

4B) User-Provided Content and Disclosure Responsibility

You are solely responsible for any content, information, images, documents, or data that you upload, attach, include, or associate with any receipt or verification session.

You acknowledge that any content you provide may be displayed, stored, processed, or transmitted as part of the Service and may be shared by you with third parties.

Zwurkz does not verify, validate, monitor, or guarantee the accuracy, legality, or appropriateness of user-provided content.

You assume all risks associated with uploading, sharing, or disclosing such content, including any unauthorized access, third-party misuse, or unintended exposure.

Zwurkz shall not be responsible or liable for any consequences arising from user-provided content or its use, disclosure, or interpretation by you or any third party.

4C) Attachments, Uploaded Files, and Storage Risk

The Service may allow you to upload, attach, store, or associate files, documents, images, or other content with a verification session or receipt.

Such uploaded content may contain sensitive, personal, financial, legal, or confidential information, and you are solely responsible for deciding what content to provide.

Zwurkz does not verify, validate, monitor, or guarantee the authenticity, accuracy, legality, completeness, or appropriateness of uploaded files or attachments.

You assume all risks associated with uploading, storing, transmitting, sharing, or disclosing such content, including loss, corruption, alteration, unauthorized access, unintended exposure, or third-party misuse.

Zwurkz does not guarantee long-term storage, preservation, retrieval, or continued availability of uploaded content, and you are responsible for keeping your own copies.

5) Retention & Destruction

Retention periods may extend where required to defend legal claims or comply with law.

6) Technical Accuracy & Anti-Spoofing Disclaimer

Geolocation may be affected by GPS drift, interference, VPN usage, device tampering, malware, spoofing, deepfake manipulation, or hardware/software malfunction.

Zwurkz Technologies, Inc. does not guarantee infallibility or forensic reliability of verification signals.

7) Security Measures & Limitation

We implement commercially reasonable safeguards including encrypted transmission (HTTPS) and access controls. No system is 100% secure. Zwurkz Technologies, Inc. disclaims liability for unauthorized access caused by device compromise or third-party breaches beyond our control.

Zwurkz Technologies, Inc. endeavors to comply with applicable United States and Canadian privacy laws, including, where applicable, state consumer privacy statutes and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). Nothing in this Policy expands statutory obligations beyond those required by applicable law.

18) No Third-Party Beneficiaries

This Privacy Policy does not create rights in any third party. No person or entity other than the user and Zwurkz Technologies, Inc. shall have any right to enforce any provision of this Policy.
